Terms of Service

These terms govern your use of SportyPants. By creating an account or using the service you agree to them, so please read them.

Who you are agreeing with

SportyPants is developed and operated by MGB. Throughout these terms, "we," "us," and "SportyPants" refer to MGB as the operator of the service at sportypants.app.

Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use SportyPants. You are responsible for making sure your use of the service is lawful where you live.

Your account

Keep your credentials confidential and let us know promptly if you suspect someone else is using your account. You are responsible for the activity that happens under it. Provide accurate information when you register, and keep your email address current so we can reach you about invitations and purchases.

Seat tokens and purchases

Pools are seated with tokens. Creating a pool consumes one token for your own seat, and each additional person you invite consumes another. A token is locked to the specific pool it was issued for: it cannot be moved to a different pool, transferred to another account, redeemed for cash, or reused once the invitation it backs has been accepted.

Prices are shown before you check out and are charged in the currency listed at checkout. Payments are handled by our payment processor, and completing a purchase is also subject to that processor's terms.

Starter tokens

New accounts may receive a small number of complimentary starter tokens so you can try the service. Starter tokens are a promotional grant, not a purchase: they have no cash value, are not refundable, and we may change the amount offered, or stop offering them, at any time. We may decline to issue them, and we may remove them or close an account, at our discretion — including where an account appears to exist mainly to collect them, such as repeated sign-ups from the same person.

Refunds

You can request a refund on a purchase from your account, and we review each request individually. Refunds are at our discretion and are not automatic.

Whether a seat can be refunded depends on what has happened to it. Tokens still sitting unused in your inventory, and seats reserved to a pool that has not started, can normally be returned. A seat that someone has already taken in a pool that is under way cannot be — pulling it back would remove a player from a competition in progress — and those seats are not refundable. Where we approve a partial refund, the amount is worked out from what you actually paid for the tokens being returned, so any volume discount you received is reflected in it.

If you believe you were charged in error, contact us and we will review it. We may decline requests that appear to be part of a pattern of purchasing and reclaiming the same product, and we may limit or close accounts that do so.

Acceptable use

SportyPants is for private, recreational pools among people who know each other. You agree not to use it to operate a gambling, wagering, or betting business, or to accept or distribute stakes, entry fees, or prizes through the service. We do not process or hold pool stakes, and any money arrangements among participants are entirely between them and outside our control.

You also agree not to access another user's account or data, attempt to bypass access controls or rate limits, probe or disrupt our infrastructure, scrape the service, resell access, or upload content that is unlawful, harassing, or infringing.

Content you submit

Pool names, messages, and other content remain yours. You grant us permission to store, display, and transmit that content as needed to operate the service for you and the other participants in your pools. We may remove content that violates these terms.

Availability and changes

We are actively developing SportyPants, so features may change, and we may add, modify, or discontinue parts of the service. We aim for continuous availability but do not guarantee it, and we may take the service down for maintenance. Scoring depends on third-party sports data that can be delayed or incorrect; we correct standings when we learn of an error but do not guarantee results.

Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent the law allows, SportyPants will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.

Suspension and termination

You may stop using SportyPants and close your account at any time. We may suspend or terminate an account that violates these terms or that creates risk for other users or for us. Unconsumed tokens in an account we terminate for a violation are forfeited.

Changes to these terms

We may update these terms. When we do we will revise the date at the top of this page, and we will give you notice by email of material changes. Continuing to use the service after a change takes effect means you accept the revised terms.
